Course description |
Constitutional Law textbooks cover three major areas: General Theory of Constitutions; Fundamental Rights (Human Rights); Governmental Institutions. In this lecture, we will study the fundamental principles of the Constitutionalism and our Constitution of Japan (1947). And we will learn about what the human rights are and the theory of governing institutions. Let us gain an awareness of ourselves as citizens who participate in the public sphere with the constitutional-based view of things. |

You are expected to: Acquire and explain the significance of the Constitution and the constitutionalism. Acquire and explain the significance of human rights. Apply legal knowledge to social issues and express your opinion persuasively. |

1. Introduction: How the lecture will proceed? What is the Constitution? 2. Sovereignty of the people: Why "sovereignty" is one of the basic principles of the Constitution? 3. Right to Equality: What is meant by "equality" under the Constitution? 4. Freedom of Conscience and Religion: Why individual conscience and faith are constitutionally guaranteed? 5. Freedom of Expression: What speech is "unprotected"? 6. Freedom of Corpus: What is meant by "Due Process of Law"? 7. Economic Rights: What economic interests are guaranteed? 8. Social Rights: Is poverty one's own responsibility? 9. Rights to Education and Work: Why these are guaranteed? 10. Pacifism: Why should we take Article 9 seriously today? 11. Constitutional Amendment: What are the nature of limits of amendment? 12. Election and the National Diet: How is the rights to vote guaranteed? What are the powers of the Diet? 13. Prerequisites |
Anyone can take this course. The lecture will proceeds with resumes, and newspaper articles and videos if necessary. Reference materials and books will be introduced. You should check legal news on newspapers, magazines, the internet and other media as well as get prepared for each class. For revise, organize the contents of each class in your own way using textbook and reference. |

I expect that there is no one who has not heard of the word "constitution." But what does it really means? How can we incorporate a sense of the constitutionalism into our daily lives? I would like to deepen our understanding of the constitutionalism and the preciousness of the fundamental rights guaranteed by the Constitution. |
